Offer and Conclusion of the Contract<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) The product descriptions in the online shop <strong>do not constitute a legally binding offer<\/strong> , but rather an invitation to place an order.<br\/> (2) By clicking the <strong>\u201cBuy now\u201d<\/strong> button, the customer submits a <strong>binding offer<\/strong> to purchase the items contained in the shopping cart.<br\/> (3) Receipt of the order will be automatically confirmed by email (confirmation of receipt). Prices and Shipping Costs<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) The prices in euros listed on the date of the order, including applicable sales tax, apply.<br\/>(2) Shipping costs are displayed during the ordering process and vary depending on the product, shipping method, and delivery address.<br\/>(3) For shipments outside the EU, additional customs duties, taxes, or fees may apply, which are the responsibility of the customer.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>5. Delivery, Delivery Area, Transfer of Risk<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) Delivery is handled by appropriate shipping providers (e.g., DHL, GLS, DHL Express).<br\/>(2) Delivery times are listed on the product page and during checkout.<br\/>(3) If delivery fails for reasons attributable to the customer (e.g., incorrect address, failure to pick up), we will bear the costs of redelivery only if we are responsible for the failure.<br\/>(4) <strong>Transfer of risk:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>For consumers: upon delivery of the goods to the customer.<\/li>\n\n\n\n<li>For businesses: upon delivery of the goods to the carrier.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>7. Retention of Title<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The goods remain the property of the seller until full payment has been made.<br\/>With respect to business customers, the extended retention of title applies (assignment of claims arising from resale).<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>8. Voluntary Return Policies<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">A voluntary return beyond the scope of the statutory right of withdrawal is only possible if it is expressly stated for the specific product.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>10. Warranties &amp; Guarantees<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) The statutory rights regarding defects apply.<br\/>(2) For business customers, the statute of limitations for claims based on defects is <strong>12 months<\/strong> from the transfer of risk. Exceptions to this are cases of statutory liability (e.g., bodily injury or harm to health, gross negligence, product liability). <br\/>(3) Manufacturer warranties apply only if they are expressly stated on the product.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>11. Liability<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) We assume unlimited liability in cases of willful misconduct, gross negligence, and for damages resulting in death, bodily injury, or harm to health.<br\/>(2) In cases of simple negligence, we are liable only for breaches of material contractual obligations (cardinal obligations), but such liability is limited to foreseeable damages typical for this type of contract.<br\/>(3) In all other respects, no liability shall apply; this also applies to legal representatives and agents.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>12. Battery Act &amp; ElektroG Information<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) Batteries and rechargeable batteries must not be disposed of with household waste and can be returned free of charge.<br\/>(2) Electrical and electronic equipment must be disposed of separately. For more information, see \u201cDisposal Instructions\u201d in the store. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>13. Damage During Shipping<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Customers are asked <strong>to report<\/strong> any obvious shipping damage <strong>to the delivery person immediately<\/strong> and to notify us.<br\/>Statutory rights remain unaffected.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>14. Contract Text, Storage, and Corrections<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) We will store the text of the contract.<br\/>(2) The customer will receive order details and the Terms and Conditions via email.<br\/>(3) Before submitting the order, the customer can correct their entries using the standard technical functions.<br\/>(4) The contract language is German; English translations are provided as a non-binding service.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>15. Coupons &amp; Discounts<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) One gift certificate may be redeemed per order, unless otherwise specified.<br\/>(2) Cash payouts are not permitted.<br\/>(3) Coupons are valid only during the specified period.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>16. Data Protection<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Our <strong><a href=\"https:\/\/pong-bot.de\/en\/privacy-policy\/\">Privacy Policy<\/a><\/strong>, which can be viewed in the online store.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>17. Online Dispute Resolution and Consumer Mediation<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) European Commission\u2019s Online Dispute Resolution platform:<br\/><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\">https:\/\/ec.europa.eu\/consumers\/odr<\/a><br\/>(2) We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>18. Governing Law &amp; Jurisdiction<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">(1) German law applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).<br\/>(2) For business customers, the exclusive place of jurisdiction is our corporate headquarters.<br\/>(3) For consumers, the statutory venue applies.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>19.
