1. Scope of Application
(1) These General Terms and Conditions (“GTC”) apply to all orders placed through the online shop of Evergold UG (haftungsbeschränkt) at www.pong-bot.de and, in the future, at www.evergold.de.
(2) Our offer is directed at both consumers within the meaning of Section 13 of the German Civil Code (BGB) and entrepreneurs within the meaning of Section 14 BGB.
(3) Any deviating terms and conditions of the customer shall only apply if we have expressly agreed to their validity.

The purpose of the company is the trading of various electronic goods, in particular intelligent sports equipment such as table tennis and tennis ball robots.
3. Offers and Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.
(2) By clicking the “Buy Now” button, the customer submits a binding offer to purchase the items contained in the shopping cart.
(3) Receipt of the order is automatically confirmed by e-mail (acknowledgement of receipt). This acknowledgement does not constitute acceptance of the offer.
(4) The purchase contract is only concluded upon our express acceptance (e.g., by sending a shipping confirmation) or by dispatch of the goods.
4. Prices and Shipping Costs
(1) The prices valid on the date of the order shall apply. All prices are stated in euros and include statutory value-added tax (VAT).
(2) Shipping costs are displayed during the ordering process and may vary depending on the product, shipping method, and delivery address.
(3) Deliveries outside the European Union may be subject to additional customs duties, taxes, or fees, which shall be borne by the customer.
5. Payment Methods
Depending on availability, we offer the following payment methods:

6. Delivery, Delivery Area and Transfer of Risk
(1) Deliveries are made through suitable transport service providers (e.g., DHL, GLS, DHL Express).
(2) Delivery times are indicated on the respective product pages and during checkout.
(3) If delivery fails for reasons attributable to the customer (e.g., incorrect address or failure to collect the shipment), we shall only bear the costs of re-delivery if we are responsible for the failed delivery.
(4) Transfer of Risk:
- For consumers: upon delivery of the goods to the customer.
- For entrepreneurs: upon handover of the goods to the carrier.
7. Retention of Title
The goods shall remain the property of the seller until full payment has been received.
In relation to entrepreneurs, the extended retention of title shall apply, including the assignment of claims arising from resale.
8. Right of Withdrawal for Consumers
Consumers are entitled to a statutory right of withdrawal of fourteen (14) days.

The withdrawal period begins:
- in the case of a single item purchase: upon receipt of the goods;
- in the case of multiple goods ordered in a single order and delivered separately: upon receipt of the last item;
- in the case of partial deliveries: upon receipt of the final partial shipment.
To exercise the right of withdrawal, it is sufficient to send a clear declaration by post or e-mail to:

Consequences of Withdrawal
We shall reimburse all payments received from you, including the costs of standard delivery, within fourteen days after receiving your notice of withdrawal. We may withhold reimbursement until we have received the returned goods or until you have provided proof of having returned them, whichever occurs first.
The customer shall bear the direct costs of returning the goods.
The customer shall only be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- unsealed hygiene or protective products;
- goods manufactured according to the customer’s specifications;
- goods which are unsuitable for return for hygiene reasons;
- digital content where the customer has expressly consented to performance beginning before the withdrawal period expires.

9. Voluntary Return Policy
Any voluntary return policy exceeding the statutory right of withdrawal shall apply only where expressly stated for the relevant product.
10. Warranty and Guarantees
(1) The statutory warranty rights shall apply.
(2) For entrepreneurs, the limitation period for warranty claims shall be twelve (12) months from the transfer of risk. This shall not apply in cases of mandatory statutory liability, such as injury to life, body or health, gross negligence, or product liability.
(3) Manufacturer warranties shall only apply if expressly indicated in the product description.
11. Liability
(1) We shall be fully liable in cases of intent, gross negligence, and for damages arising from injury to life, body, or health.
(2) In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.
(3) Any further liability is excluded. This also applies to our legal representatives and agents.
12. Information under the German Battery Act and Electrical Equipment Act
(1) Batteries and rechargeable batteries must not be disposed of with household waste and may be returned free of charge.
(2) Electrical and electronic equipment must be disposed of separately. Further information can be found in the “Disposal Information” section of our online shop.
13. Transport Damage
Customers are requested to report any obvious transport damage immediately to the delivery service provider and to inform us accordingly.
This does not affect any statutory rights or claims.
14. Contract Text, Storage and Correction of Entries
(1) The contract text will be stored by us.
(2) Customers will receive the order details and these GTC by e-mail.
(3) Before submitting an order, customers may correct their entries using the usual technical means provided during the ordering process.
(4) The contract language is German. English translations are provided solely as a non-binding service.
15. Vouchers and Discounts
(1) Unless otherwise specified, only one voucher may be redeemed per order.
(2) Cash redemption of vouchers is excluded.
(3) Vouchers are valid only during the period specified.
16. Data Protection
Our Privacy Policy, available in the online shop, shall apply.
17. Online Dispute Resolution and Consumer Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR):

(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
18. Applicable Law and Jurisdiction
(1) German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) For entrepreneurs, the exclusive place of jurisdiction shall be our registered office.
(3) For consumers, the statutory provisions regarding jurisdiction shall apply.
19. Final Provisions
Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
