1. Scope

(1) These General Terms and Conditions apply to all orders placed through the Evergold GmbH online store at www.pong-bot.de as well as, in the future, www.evergold.de.
(2) Our offer is directed at both consumers (Section 13 of the German Civil Code (BGB)) and business customers (Section 14 of the German Civil Code (BGB)).
(3) Any deviating terms and conditions of the customer shall apply only if we have expressly agreed to their validity.

The company’s business is the sale of various types of electronic goods, particularly smart sports equipment such as table tennis and tennis ball machines.

3. Offer and Conclusion of the Contract

(1) The product descriptions in the online shop do not constitute a legally binding offer , but rather an invitation to place an order.
(2) By clicking the “Buy now” button, the customer submits a binding offer to purchase the items contained in the shopping cart.
(3) Receipt of the order will be automatically confirmed by email (confirmation of receipt). This does not yet constitute acceptance of the offer.
(4) The purchase contract only comes into effect upon our express acceptance (e.g. shipping confirmation) or upon delivery of the goods.

4. Prices and Shipping Costs

(1) The prices in euros listed on the date of the order, including applicable sales tax, apply.
(2) Shipping costs are displayed during the ordering process and vary depending on the product, shipping method, and delivery address.
(3) For shipments outside the EU, additional customs duties, taxes, or fees may apply, which are the responsibility of the customer.

5. Payment Methods

Depending on availability, we offer the following payment methods:

6. Delivery, Delivery Area, Transfer of Risk

(1) Delivery is handled by appropriate shipping providers (e.g., DHL, GLS, DHL Express).
(2) Delivery times are listed on the product page and during checkout.
(3) If delivery fails for reasons attributable to the customer (e.g., incorrect address, failure to pick up), we will bear the costs of redelivery only if we are responsible for the failure.
(4) Transfer of risk:

  • For consumers: upon delivery of the goods to the customer.
  • For businesses: upon delivery of the goods to the carrier.

7. Retention of Title

The goods remain the property of the seller until full payment has been made.
With respect to business customers, the extended retention of title applies (assignment of claims arising from resale).

8. Right of Withdrawal for Consumers

Consumers have a 14-day right of withdrawal.

The deadline begins:

  • When purchasing an item: upon receipt of the merchandise,
  • For orders containing multiple items that are delivered separately: upon receipt of the last item,
  • For partial deliveries: upon receipt of the last partial shipment.

Consequences of Cancellation:
We will refund all payments, including standard shipping costs, within 14 days of receiving notice of cancellation. We may withhold the refund until we have received the goods or the customer has provided proof of return.

The customer is responsible for the direct return shipping costs.

The customer is liable for any loss in value only if the goods are handled in a manner that is not necessary.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply in the following cases:

  • unsealed hygiene and protective products,
  • Goods that were manufactured according to customer specifications,
  • Items that cannot be returned for hygiene reasons,
  • digital content, provided the customer has expressly agreed that performance may begin before the end of the cancellation period.

9. Voluntary Return Policies

A voluntary return beyond the scope of the statutory right of withdrawal is only possible if it is expressly stated for the specific product.

10. Warranties & Guarantees

(1) The statutory rights regarding defects apply.
(2) For business customers, the statute of limitations for claims based on defects is 12 months from the transfer of risk. Exceptions to this are cases of statutory liability (e.g., bodily injury or harm to health, gross negligence, product liability).
(3) Manufacturer warranties apply only if they are expressly stated on the product.

11. Liability

(1) We assume unlimited liability in cases of willful misconduct, gross negligence, and for damages resulting in death, bodily injury, or harm to health.
(2) In cases of simple negligence, we are liable only for breaches of material contractual obligations (cardinal obligations), but such liability is limited to foreseeable damages typical for this type of contract.
(3) In all other respects, no liability shall apply; this also applies to legal representatives and agents.

12. Battery Act & ElektroG Information

(1) Batteries and rechargeable batteries must not be disposed of with household waste and can be returned free of charge.
(2) Electrical and electronic equipment must be disposed of separately. For more information, see “Disposal Instructions” in the store.

13. Damage During Shipping

Customers are asked to report any obvious shipping damage to the delivery person immediately and to notify us.
Statutory rights remain unaffected.

14. Contract Text, Storage, and Corrections

(1) We will store the text of the contract.
(2) The customer will receive order details and the Terms and Conditions via email.
(3) Before submitting the order, the customer can correct their entries using the standard technical functions.
(4) The contract language is German; English translations are provided as a non-binding service.

15. Coupons & Discounts

(1) One gift certificate may be redeemed per order, unless otherwise specified.
(2) Cash payouts are not permitted.
(3) Coupons are valid only during the specified period.

16. Data Protection

17. Online Dispute Resolution and Consumer Mediation

18. Governing Law & Jurisdiction

(2) For business customers, the exclusive place of jurisdiction is our corporate headquarters.
(3) For consumers, the statutory venue applies.

19. Final Provisions

If any provision of these Terms and Conditions is invalid, the validity of the remaining provisions shall remain unaffected.
